Terms of Service

Hammertally is operated by Lot 313, LLC, a Delaware limited liability company (“we”, “us”). These Terms are an agreement between you and us for your use of this website and your purchase of Hammertally. They supplement our general Terms of Service, which apply to anything these Terms do not cover; where the two conflict, these Terms apply to Hammertally. By making a purchase you agree to them. If you do not agree, please do not buy.

What you buy

Hammertally: a free Whatnot fee calculator and a browser-based per-show profit report for Whatnot sellers. The first show in your file is free. Paid subscriptions are not on sale yet.

Immediate: the calculator and the report run in your browser as soon as the page loads. Nothing is purchased on this site today.

Hammertally is a digital product delivered online. You must be at least 18 years old, or the age of majority where you live, to make a purchase.

Prices, payment and tax

Prices are shown before purchase. Digital purchases are processed through Stripe Managed Payments: for those purchases, Link (a Stripe service) is the seller of record. Link collects payment and any applicable sales tax, VAT or GST, sends your receipt, and offers order and payment support, and the terms shown at checkout also apply to your purchase. Where checkout does not show Link as the seller, Stripe processes the payment for us and we are the seller. Either way, we provide the product, and these Terms govern the product itself.

Refunds

Nothing is sold yet: the calculator and the report are free. When subscriptions go on sale, their refund terms will be shown on the page before purchase.

To ask for a refund, contact us (below) with the email address used at checkout. Approved refunds go back to the original payment method; your bank may take several business days to show them. Nothing here limits any refund right you have under applicable law.

Product terms

• Hammertally does arithmetic on numbers you enter or a file you load. It is not tax, accounting or legal advice, and its figures are not an official statement: check them against Whatnot's statements before you rely on them.
• Fee rates come from Whatnot's public help pages as of the date shown on the calculator and can change without notice; the calculator is an estimate.
• Hammertally is an independent tool and is not affiliated with Whatnot.

Your responsibilities

Give accurate information, send us only content you have the right to share, and use Hammertally lawfully. Do not misuse this website or interfere with its operation. We may refuse or cancel an order (with a full refund) that breaks these rules.

Intellectual property

You keep ownership of what you send us and permit us to use it only to provide Hammertally to you. While you have access, you may use Hammertally for your own business, and the documents and data you create with it remain yours. This website, the software and our materials otherwise remain ours.

No guarantee of results; disclaimer

We do not guarantee any business outcome, such as traffic, rankings, conversions or revenue. Apart from the commitments in these Terms and on the product page, Hammertally is provided “as is”. To the fullest extent the law allows, we disclaim all other warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

To the fullest extent the law allows, our total liability for any claim relating to Hammertally or these Terms is limited to the amount you paid for Hammertally in the 12 months before the claim arose, and we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Nothing in these Terms limits liability or consumer rights that cannot be limited by law.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Please contact us first so we can try to resolve any issue informally.

Changes

We may update these Terms. The version on this page, with its effective date, applies to purchases made on or after that date.
